This Website Package ("Agreement") is made and entered into by and between, Warner Digital Media Design ("WDMD") and You (“The Client”).
To create a website the you or your company is happy with. This website will portray your company or organization in a positive light and be an online presence that your company will keep 24/7/365.
Your website is custom built to fit the your company’s needs. Your website will automatically receives five pages that we will build. In those five pages, you may host whatever content you'd like to display on their website. You will also supply images to us. However, images must be original and not taken off of unsourced areas of the internet. If you don't have any images, WDMD can supply some at no extra charge. Websites that are over 5 pages may incur additional costs for the main build of their websites. The add-on charges are a one time fee due upon the start of the website build:
E-Commerce Implementation (1-25 products): $325 Specialty quotes will have to be arranged for e-commerce sites over 25 products. New Pages: $20/per page Blog Integration: $50
Upon submitting the your desired domain name (http://www.ExampleDomain.com). We’ll make sure we secure your desired domain name. From there you won’t have to worry about a thing. WDMD will take care of the yearly cost to maintain the your domain name. Want to add another distinct domain to the your site? No problem, an additional $2 charge will be applied to the your's monthly payment. Already, have a domain name? That isn’t an issue either. You can either let us take care of the domain name or we’ll deduct $2 off your monthly statement, if you decide to take care of the domain maintenance.
All websites under the WDMD website maintenance package must be hosted on the WDMD servers. We take fantastic care of our servers and make sure they stay intact and up to date. Our team will ensure your site stays live everyday.
Along with your website package you will also receive the opportunity to get as many company email addresses as you want. All the you have to do is email WDMD with your requested email address and WDMD will do the rest. After about 1-2 business days you will receive an email address, password, and login to access to your webmail account.
Wondering how many people are visiting your website? WDMD will supply Google analytics that will be sent right to your inbox every month. From that report your will be able to see the total traffic for the previous month.
Search Engine Optimization Being found online is definitely a very important task when starting a website. WDMD will make your site more visible on Google and other search engines. WDMD will perform search engine submissions as well as insert distinct keywords for your company into your website so you are more visible on Google.
Website Maintenance is service that will provide the you 5 monthly edits to the your website. You will also be able to submit changes through your client portal. These monthly edits can be made to any page on the your site. This is great if the you have monthly specials that your visitors would like to see. The only thing WDMD will not create is graphics for these pages. Images can be provided but WDMD is not responsible for editing images for advertisements (this process would be a separate fee).
Web site package - $30 a month
The above pricing is effective through two years upon agreeing to this contract. The first payment is due upon the agreement of the suggested domain name. After that process is completed, the above price will be billed in monthly cycles.
WDMD has set up a Client Portal so you can manage the your monthly bills and set up auto payment so the your site never has an issue.
All payments are due within 15 days of billing WDMD recommends setting up the automatic payment in their client portal. If the outstanding balance on the your account exceeds 15 days; WDMD will shut down hosting, thus shutting down your website. You will receive a phone call before action has taken place.
WDMD will provide a finished product to the you in the form of the website being uploaded to the WDMD servers. These files become the exclusive property of your company upon acceptance of delivery, however these files are partially based on a non-exclusive code base created and maintained by WDMD and in some cases existing code was used to help create the deliverables. Such code and other underlying technologies do NOT become the property the Client(you), only the Finished Product(s). In addition, the Finished Product(s) may depend on code, objects (COMs), and other third party utilities that are the property of their respective owners. No rights to these dependencies is expressed or implied. Additional licensing may be required with third party assets.
If the you wish to move the your site before the first anniversary with WDMD a $360 moving fee will be assessed to you or your company. After the first anniversary with WDMD. You may move the your site and domain where ever you'd like. WDMD offers a movement fee of $150. In this service we can relocate the your site as well as plugin the site to the correct databases.
WDMD maintains internal backups of active project code and design files. While the WDMD backup system is fully redundant, it is not guaranteed and does not support any content produced by you.
Although WDMD makes every effort to provide secure product(s), due to the nature of rapidly advancing technology, WDMD can in no way guarantee that the Product(s) will not be subject security breaches. WDMD recommends the use of strong passwords and the observance of standard security practices. In order to minimize the chances of security violations, systems should be updated often.
You are agreeing that any liability of WDMD relating to this agreement and the services performed shall be limited to the amount of fees actually received by WDMD, from you under this agreement regarding the services in question. In no event shall WDMD be liable for any special, incidental, indirect, cover, consequential, exemplary or punitive damages; any damages based on injury to person or property; or any lost sales, profits or data, even if you are is told that any such damages may occur.
WDMD will provide patches and bug fixes for any bugs or issues included in the scope of this contract reported.
Hourly projects are NOT subject to warranty. Design and the placement, editing and arrangement of editorial content are NOT subject to warranty. Should further support be necessary, a support contract may be negotiated.
WDMD retains the right to use your site within its roster of clients. A link to your website will be placed on the WDMD web site as part of its business portfolio.
Responsibility
Warner Digital Media Design will make every reasonable effort to ensure the accuracy of what is produced. Warner Digital Media Design is not responsible for your grammatical errors or misspellings. We will try our best to prevent them but please check your content before sending.
You are responsible for all clearance of legal issues that maybe associated with their sites. For example logo’s, graphics, pictures, copyright material, trademarks, etc. Images and content copied from websites or Google Images will not pass for content and images on the your site. Doing this would be against all copy right laws and is illegal.
To proceed with this project, you will be required take the following steps: 1. Accept that the you have read this online aggreement 2. Login or Call WDMD to make the your first payment to lock in the your domain name. 3. Submit the your content to WDMD 4. Kick back and relax! We will take care of the rest!
